Renée is a Commercial Attorney, Conveyancer and Notary Public with 15+ years’ experience.

She started her career in commercial litigation with a focus on contractual disputes in the franchising, construction and property development sectors. Over time she developed particular expertise in real estate law, both from a transactional and dispute resolution perspective.

This led her to establish Nienaber Attorneys in June 2018 where she pursues work as a holistic real estate and wealth protection practitioner with a reputation for practical solutions, high quality legal advice and attention to detail.

Renée overseas the estate administration and real estate practices of the firm.

Her background in litigation and the decade she spent working at top tier law firm Adams & Adams has helped her build the skills needed to keep complex and contentious deals on track as a conveyancer and real estate dispute resolutionist.

She is often briefed to assist private clients with property acquisitions from the start of negotiations through to a successful transfer.

Renée is also known for her ability to resolve contentious and high value deceased estates, and is often appointed as executor by longstanding clients who trust her ability to navigate complexity and intricate estate and business structures.

She excels at building relationships, and is skilled at assessing risk and developing nuanced approaches to meet divergent client needs.

As an entrepreneur and business owner herself she understand clients’ commercial goals and she thrives in helping clients deal with legal risks and challenges to build sustainable businesses. She look for practical solutions to clients’ commercial legal problems and builds on past experience to achieve effective results.

Relevant experience

  • Drafted and negotiated a suite of transactional instruments for the acquisition of key commercial property to facilitate the plant expansion of a multinational manufacturer in the automotive industry;
  • Drafted deeds of sale and multi-phase building progress agreements in use for all developer’s sales of commercial and residential stands, full title townhouses and sectional title townhouses at multiple upmarket new developments in Gauteng and the Western Cape;
  • Successfully represented and advised a major local listed property development and investment group in various matters against local authorities, building contractors and competing developers involving development mandates, construction agreements, preferred contractor/supplier agreements, unlawful competition, statutory and regulatory compliance, environmental law, unlawful occupation of land and B-BBEE, as well as cross-border construction disputes;
  • Assisted a multinational manufacturer in the pharmaceutical industry with contract review and the drafting and negotiation of all of its distribution agreements (service levels, licencing and supply) with distributors in Southern Africa and West Africa;
  • Successfully represented a multinational pharmaceutical company in various local litigious matters in proceedings before the High Court, Supreme Court of Appeal and Constitutional Court;
  • Successfully renegotiated the terms of their franchise agreements with a multinational automotive manufacturing group on behalf of a group of 63 franchisees;
  • Revised the standard terms and conditions and project charters of a well-known local software implementation group for both its South African and US operations to ensure regulatory compliance with specific reference to POPIA and international privacy protection laws;
  • Represented and advised two prominent multinational players in the FMCG industry in relation to numerous commercial/contractual matters and disputes, including with regard to supply chain service agreements, commercial lease disputes, recovery of damages for fraud and breach of contract, damages suits brought against the company in connection with defamation claims, personal injury and material damages claims;
  • Pursued and obtained interdictory relief to curb unlawful competition by competitors and/or ex-employees for, amongst others, a well-known local retail group, a multinational insurer, the local division of a German engineering company and local training and consulting firms.
